COPYRIGHTS

Copyright issue at Supreme Court on Jan. 21, 2014.

Issue: Whether the nonstatutory defense of laches is available without restriction to bar all remedies for civil copyright claims filed within the three-year statute of limitations prescribed by Congress, 17 U.S.C. § 507(b).

Put another way: Did the daughter of the screenwriter of Raging Bull claim her rights too late (state law laches issue - she waited 18 years to bring her first infringement claim), or did the Copyright Act allow her to bring the claims in 2009?

The Copyright Act's statute of limitations requires claims to be brought within 3 years of infringement.
